Terms of Use
These terms govern the Brown Noise Free mobile application operated by Peyton Greenwood (the "Service Provider"). By downloading or using the Application you agree to these terms.
Not a Medical Device
The Application is provided for relaxation, sleep and focus. It is not a medical device, and it does not diagnose, treat, cure or prevent any illness or condition. Nothing in the Application constitutes medical advice. If you have persistent difficulty sleeping, ringing in the ears, or any other health concern, consult a qualified healthcare professional.
License to Use the Application
You receive a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes. You may not reproduce, distribute, modify, reverse engineer, decompile, or create derivative works from the Application or its audio content, or redistribute the audio content as your own.
Intellectual Property
The Service Provider retains ownership of all intellectual property in the Application, including its code, design, audio content and branding. You may not use the Service Provider's trademarks or remove any proprietary notices.
Free Features and Purchases
Brown noise playback, the sleep timer and background playback are available at no cost and with no time limit. An optional purchase unlocks the remaining noise colours, the nature sound library, and the ability to layer multiple sounds.
Subscriptions and In-App Purchases
The Application offers the following optional purchases:
- Yearly — $19.99 per year, including a 7-day free trial
- Monthly — $6.99 per month
- Weekly — $2.99 per week
- Lifetime — $39.99, a one-time purchase with no recurring charge
Prices are shown in US dollars and may vary by region. Subscriptions automatically renew for the same duration and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
You can manage or cancel a subscription in your device Settings under your Apple ID → Subscriptions. If you cancel during a free trial, access continues until the trial period ends. Any unused portion of a free trial is forfeited when a subscription is purchased.
All payments are processed by Apple. The Service Provider cannot issue refunds directly. Refund requests are handled by Apple at reportaproblem.apple.com.
Eligibility and Age of Consent
You must be at least 16 years old, or have the consent of a parent or guardian, to agree to these terms.
Third-Party Services
The Application uses Sentry (crash reporting) and RevenueCat (purchase validation). Their own terms and privacy policies apply to the data they process. See the Privacy Policy for details.
Connectivity and Device Responsibility
You are responsible for your device, its security, and any network or data charges you incur. The Service Provider is not responsible for connection failures or associated charges. Audio playback itself does not require an internet connection; validating a purchase does.
Termination
The Service Provider may suspend or terminate your access for a material breach of these terms, allowing 14 days to remedy the breach where a remedy is possible. Termination may be immediate in cases of unlawful use or intellectual property infringement.
Limitation of Liability
To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Application. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under applicable law.
Indemnification
You agree to indemnify the Service Provider against claims arising from your breach of these terms or your misuse of the Application.
Application Updates
Updates may be required for continued use. The Service Provider does not guarantee compatibility with every operating system version and may modify or discontinue the Application.
Governing Law and Jurisdiction
These terms are governed by the laws of the jurisdiction in which the Service Provider is established, without regard to conflict-of-law principles. Nothing here removes consumer protections that apply to you under the mandatory law of your country of residence.
Severability
If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full effect.
Entire Agreement
These terms and the Privacy Policy constitute the entire agreement between you and the Service Provider regarding the Application, superseding any prior understandings.
Changes to These Terms
The Service Provider may update these terms from time to time. Material changes will be posted on this page with an updated effective date.
